Pesticide Poisoning (California)

It's time for another incredible story. A female employee needs to catch up on some paperwork so she goes into the office over the weekend. Her desk is near the air conditioning vent which fortunately is working on this fine Saturday morning. Within 30 minutes she becomes violently ill. A co-worker who happens to be in the office hears the commotion and comes over to see what is going on. She takes one look at her violently ill co-worker and immediately calls an ambulance. At the hospital blood tests reveal that the employee is suffering from pesticide poisoning...Dursban 4E insecticide to be exact. It was in her blood. How in the world did that happen? An investigation revealed that she was at her desk that Saturday morning the gardener was outside spraying pesticide around the perimeter of the air conditioning unit. He was spraying Dursban 4E insecticide. Incredibly the workers' compensation claim was denied by the adjuster citing lack of proof that pesticide from that particular Saturday spraying event caused the employee's violent and sudden illness. Amazing!

By statute, any physician with knowledge or reasonable suspicion of a pesticide poisoning must issue a Doctors First Report of Occupational Injury or Illness and send a copy immediately to the local County Public Health officer and promptly to the state Department of Industrial Relations. It would seem those entities might acquire information to support the claim and prevent such incidents in future. If the report was not submitted, the provider may be liable for penalties. This information is at the top of every Doctors First Report of Occupational Injury or Illness form.
