1997 PDR rating (California)

Can someone tell me how to rate intermittent moderate to severe abdominal pain under the old 1997 PDR?

The closest I can come is abdominal weakness (hernia) - 13.1. 13.1 also refers to the spine/torso Guidelines (12.1). For 13.1, intermittent (1/2) of moderate (30%) to severe (50%). 1/2 (30 + 50 = 90/2 = 40%) 20% standard. Intermittent moderate/severe spinal subjective yields 35% standard. Technically one should provide the work activities that produce pain, which is the third modifier. For example, if one had your subjective pain with say heavy lifting, then the 40% is multiplied by .20 = 8% standard, or 35% x .20 = 7%. Subjectives should include frequency, degree and activities per PDRS 1-8.

Intermittent moderate to severe abdominal pain

13.1 abdominal weakness refers you to the Spine and Torso Guidelines

constant moderate pain = 50%

Per PDRS page 1-7 the value must be deceased proportionally for a frequency less than constant. intermittent is 50% of constant so 50% x 50 = 25

LC9727 define severe pain as precluding an activity, constant pain with all activities would be 100%. Intermittent modifies this to 50%.

The subjectives are intermittent moderate to severe abdominal pain, so 50 + 25 = 75/2 = 37.5 rounds to 40% standard.

No activities has been given as to when the pain occurs. PDRS 1-8 indicates that pain may be further modified by the activity for which is occurs and the activities that precipitate pain be described (as previous poster indicated). This could reduce the rating substantially from 40%.

We are close Andy, but 1-8 says should not may be. This example is missing an important piece. The way is reads now is he has 40% all the time (at rest/sleeping/etc.). If I am DA, I get work activities that cause pain and modify.
