assume a 100% award with atty fees commuted from the award payable forthwith. payments of PD are deducted bi-weekly to recoup back the atty fees paid over the lifetime of the award. Go forward, years have passed the applicant still alive and all of the atty fees have been recovered. is there any law or statue that requires the defendant to increase applicants award to the full pd amount or are they allowed to continue to make the deduction even thought atty fees have been recovered.?

Once the Attorney fees have been recovered and the credit for commuting a lump sum, the 100% PTD is supposed to be paid at the full amount, per law. But would need to see the legal paperwork to assure nothing else is amiss.

Your attorney should handle this issue, however if your attorney has been dismissed from your case, contact your local Information and Assistance officer (numbers on line) to secure assistance with the issue.
