Should I switch Attorney (California) (California)

Postby Luckyazkd9 on Sat Feb 08, 2020 6:55 pm

I apologize in advance for my long post. A two man law firm has been my AA for twenty years. One of the partners died. My PTP lost his licenses June 2019 and was sentenced to jail. I immediately notified my AA via letter and requested a new PTP. My last PTP visit was on June 2019 and I finally get a new PTP appointment on December 17, 2019. I know things move slowly in W/C but six months to get a new PTP? New PTP after a 31/2 hours tells me "I don't know what I am suppose to do with you". "I don't do pills which it appears you want (former PTP had me on Tramadol 2X daily and Gabapentin 2X daily) so I am just going to refer you to a Pain Specialist." I told them my Lumbar had gotten worst. Two Lumbar surgeries. last one with four braces, rods and screws. When I get out of bed or after sitting for a while, my Lumbar becomes very painful, 7-8 range, when I stand up. Lumbar pain never goes away and remains at a 4-6 level. Pain pills help some. I immediately wrote to my AA requesting who was suppose to tell the new PTP what to do? As of this date I have not received an explanation. The new PTP was to give me a new rating, a referral to the AME who would also give me a updated rating. Last AME report was 2014. I felt all rating were stale. I believe my current AA does not have the time to do what is necessary for my case. I also have a Serious and Willful claim. Medical expenses and all benefits paid have well gone over a million dollars. Company was cited for failure to have handrails on the stairways to the loading dock. (I fell backwards and landed on my back on the concrete floor). Testimony (depositions) of two other employees state they also told management about the lack of handrails. Should I change AA after twenty years. Will I be able to find a new AA to take my case as the 15% shall have to be split? If anyone knows of a GOOD San Fernando Valley AA who could be interested please have them contact me at 818 367 8033. and ask for the Arizona Kid, my workcomp name. I have a formal meeting scheduled with my current AA on Feb. 13, 2020. The outcome of that meeting shall determine if I continue with him or seek a new AA. I am like a buzzard that is tired of waiting for something to die and has determined it's time to just go out and kill something to eat. All responses are most welcomed. This Board has enlighten me in so many ways. I sincerely Thank those who have taken the time out of their hectic lives to offer me guidance.

If you were seen by a surgeon and if he does not believes you need surgery, it sounds like pain management doctor is appropriate.

I had my meeting with my AA. He was in agreement my case should have received greater attention. I am to receive a copy of the latest new PTP report. A definite plan to resolve and close my case shall be prepared. I shall receive a monthly status report. He told me the lower the cost of a Medical Set Aside the greater the chance the insurance company would provide one. In other words shift the cost of treatment to Medicare. The current system makes you go through misery (a kind word) in order to obtain medical treatment and prescriptions. I believe is designed to make you want to jump to Medicare.

To all those who responded to my question, I sincerely THANK YOU. To land in the world of W/C is a curse I would not wish upon anyone. As a side note I would like to point out my employer who was the largest drug distributor in the nation was fined a whole $35.00 for "failure to have handrails on any of the three access points to the loading dock". A just world?
