Time frame to Object to DOR (California)

Postby desertsquire on Wed Jul 08, 2009 3:22 pm

I have filed a DOR on 6/8/09 and opposing counsel has issued an objection per their proof of service 6/19/09. Under RR 10416 the opposing party has 10 days to file and serve any objection. Does the 10 days start from the actual filing date of the DOR on the proof of service, or is it 5 days from the actual proof of service plus 10 days to file the Objection. It is believed that it is only 10 days from the date of the DOR proof of service. I need clarification.
