QME missed appointment fee (California)

ML100 does not provide for a missed appointment fee amount. Is there a standard or anything supporting what a QME would be entitled to for a missed appointment fee?

When I write an appointment letters to the parties, I always document that I have a two hours of QME time ($500.00) fee for a QME no-show. The attorneys always want to know what the fee is, but collecting it is a hit or miss proposition. A few times my policy has been honored, sometimes the IC has reimbursed $250.00, but probably 75% or more of the time no one will pay for it.

It should be based on the amount of billable hours that were actually lost for they physician. The chances any physician is 100% up to date on the medical record reviews for upcoming evaluations or pending reports, probably rare. This is why they are not paid. So if you shift gears and work on something else you are billing for you haven't lost at time.

Some PQMEs make it more of a contractual agreement - if it is too high, that is enough to invalidate a panel as well.

Is there any authority for replacing a PQME (before the first evaluation ever occurs) for submitting an excessive missed appointment fee? In my case, the missed appointment fee is $1,000.

well I presume of their usual and customary fee is $1000,000 they can bill it. Does not mean it will get paid or that it's a defective panel.

I argued $350 was excessive for a missed appointment fee and the judge granted me a replacement panel. I used the previous arguments above. I think $250 without any prior review of records is adequate. Most QMEs can fill the time with other work quickly.

So simply by charging too much, or sending out too large a bill for a no show they can be removed from the case? I didn't know that.

Anytime you enter into a dispute, even a billing dispute with a party to the case, you risk being viewed as biased in the case. So just keep it reasonable. If you keep it reasonable, there will be no issues.
