Panel QME Report (California)

Panel QME report does not constitute substantial medical evidence as the doctor indicates IW has no radiculopathy even though the IW clearly marks on her medical history forms (graphic human figure) that she has pain radiating down her left leg. PTP (reputable orthopedic surgeon) finds a 5 mm disc and IW a candidate for surgery. The problem is that he will not issue a rebuttal report to the panel report because the carrier has not paid his bill. Wee need a PR-4 from the treater in order to rely on that report in lieu of the panel report. How can I get the PTP's bill paid. Thanks!

You file a petition & DOR for a status conference/ Expedited Hearing re discovery and get the WCJ to order the defendant to authorize a 1 time PTP medical legal report reviewing & commenting on the PQME report. Otherwise, your discovery rights will be prejudiced and/or irreparable harmed.

That is one way. Or, you could send the new PTP report to the QME for comment.

Honestly, it all sounds kind of premature and irrelevant if the IW is going to have surgery. If she does, then you are looking at a QME re-eval anyway and most likely new criteria for rating. I assume the goal of the surgery will be to help the radiculopathy, right?
