Interpreters When PTP is Spanish Speaking () (California)

Quick question regarding interpreting services rendered with a non-mpn physician.

We have objected to the chiropractor, physical therapist and consulting physician(s) who are all outside of the employers MPN and located in the same building, suite number, etc. The issue is that an interpreter is also rendering services for all office visits (evaluations, manipulations, PT, etc). This particular facility indicates that the office staff speaks spanish, including the chiropractor, therapist and consulting physicians. Is there any case law that indicates that interpreting services are not necessary for chiropractic manipulation, and physical therapy other than the intial evaluation, subsequent evaluations, etc. I've reviewed 9795.3 but curious to see if there are any case in point, etc. It should be noted that when the interpreter also renderes the service no narrative reports are being issued, etc.

What defenses do defendants have? Any help would be appreciated.

My Work Comp Index, 7th edition, 5/08, page 403 under "Interpreter, Fee for, Contd." subsection " * Medical treatment," discusses the Garcia and Perez cases mentioned in rosellavera's link, together with 5 other cases, giving cites to all so the actual cases can be reviewed.

Next new edition will be in the late spring/early summer of 2010. Meanwhile, I'm offering heavy discounts and as usual I pay all shipping and sales tax.

Check out GOVERNMENT CODE 11435.20. (a) The hearing, or any medical examination conducted for the purpose of determining compensation or monetary award, shall be conducted in English.

Just because one can play the piano doesn't mean one can play like MOZART. Therefore, the speaking of Spanish by staff members or the physician doesn't equate to that of an Interpreter. Simply read some of the writings posted allegedly in ENGLISH.

lol... sorry, but the question begs to be asked... Is the IW Spanish speaking ? Or, is the IW caucasian with SSL/Spanish Second Language ? Why, or how, did a caucasian, non-Spanish speaking IW get to an all Spanish speaking medical provider facility ?
HOW dose this this group submit PR-2's ? Is UR doctor answering in Spanish, CA ?
If there are no narrative reports, what are you using to verify services/treatment have been provided ?

There is one racket going one here... that appears to be the interpreter.
