Petition to strike panel QME report (California) (California

AA objected to panel QME report based on insufficient medical evidence and inaccurate medical history. Case is set for MSC and AA filed a petition to strike the report. DA objected to the petition stating that the Trier of fact must decide whether the report constitutes substantial medical evidence at the time of trial. Does the judge rule on the petition prior to trial?

So it's premature to file the petition prior to trial? Or MSC?

The petition is timely, but the ruling is for the trial judge to decide.
