Payment of housekeeper through company check (California)

If a personal housekeeper of a company CEO is paid by company check, is there an argument that they are an employee of the company as opposed to covered under homeowners insurance? Would that CEO have any potential liability for paying a personal employee by company check?

Yep, pay from company, company employee. Why would you pay personal expenses from your business account? Bad business all around. The CEO was acting in a dual role and had control, the company paid the wages will most likely be liable for the workers' compensation. If the CEO wanted it to be on his homeowner's , should have paid on a personal check.

First rule of thumb for me is to follow the money to find the employer. Is there an IC defense though?
