Code seems to reference applicant specifically for seeking fees relating to writs. Is there a similar provision or case law regarding, Defendant's right to petition for same?

Yes, if you prevail you can sanction for attorney fees (costs) whether you are an applicant or a defendant. These are not granted frequently, but they are granted from time to time.
