ergonomic work station (California)

The adjuster has taken the position that the need for an ergonomic work station is an issue between the EE and ER, and not a work restriction which would lead to TTD. The ER is in the process of obtaining an ergonomic eval, which tends to indicate that the station is not ergonomically correct at this time. Therefore, it is our position that this constitutes a work restriction, until the work station can be ergonomically modified, and that, until that time, the EE cannot return to work and should receive TTD.

Once IW is released to RTW, with restrictions... if the ER cannot make the accommodation as requested, the IW generally must return to the PTP for a change in status...PD/PPD to TTD/TPD... the CA, nor ER, or AA can make the medical determination to change the restrictions of the PTP.

Therefore, it is our position that this constitutes a work restriction, until the work station can be ergonomically modified, and that, until that time, the EE cannot return to work and should receive TTD.
Who is the ''our'' in our position ?
IMHO... you'll have to contact/return to PTP for clarification or change.
